There is liability associated with almost everything we do, which is why personal injury becomes such a likely experience that anyone can encounter. When mentioned, most people think of personal injury and envision a horrific car accident or maybe a slip and fall in the workplace. While these are definitely two types of personal injuries, it doesn’t begin to scratch the surface of the plethora of types of cases here in Georgia. As defined by the American Bar Association, a personal injury case is a type of tort lawsuit that has two primary components, liability and damages. Someone involved with this type of case has endured physical injuries to their body, mind, or emotions due to the negligence of someone else. Instead of overwhelming you with every single type of personal injury case, I want to briefly highlight the most common ones in Georgia.
Car accidents, medical malpractice, slip & fall, workplace accidents, product liability, and more. Continue reading to learn about the most common ones.
Car Accidents: In 2020, the Georgia Department of Transportation (GDOT) reported a total of 331,798 crashes in the state. Of those, 124,493 resulted in injury. With victims not being limited to drivers but extending to passengers and pedestrians, it is easy to understand how this is the most common type due to whom all can be impacted.
Medical Malpractice: With a large portion of the population interacting with medical professionals to ensure their overall wellbeing, medical malpractice is not only an extremely common type of personal injury but one of the most dangerous. According to John Hopkins University, more than 250,000 people die every year due to medical malpractice and negligence. From misdiagnosis, surgical errors, and wrong medications, this type of personal injury is both complex and laborious for even the most experienced lawyers.
Slip & Fall: Also known as premises liability, a slip and fall is what many people can easily envision when thinking about personal injury. We have all seen this type of case in film and heard about it on our local news station. What makes this common is that it can, without exaggeration, happen anywhere and to anyone. This type of personal injury is due to a property owner having defective conditions and holds them liable for such accidents.
Workplace Accidents: We spend most of our time at work, which makes it an easy site for accidents to occur. Worker’s compensation makes handling this type of case fairly simple, however, depending on the type of negligence fault is not always that of the employer.
Product Liability: When interacting with any product, our default thought is that it is safe for us to use. We trust that the manufacturer has abided by the proper laws before allowing the public to interact with their product. The reality is that this is not always the case. Medical devices, toys for young children, and even cars can pose a product liability.
While this is not a comprehensive list of all the various types of personal injury cases, this list does prove my original point that there is liability associated with almost everything we do! And most times, it is in fact personal!
